GENERAL TERMS AND CONDITIONS
SCOPE
The General Terms and Conditions (hereinafter referred to as "GTC") apply to all legal transactions concluded via the online shop www.oykami.ch. The online shop is operated by the company ØYKAMI GmbH, which acts as the contracting party for all legal transactions. ØYKAMI GmbH is registered in the commercial register. ØYKAMI reserves the right to change the GTC at any time and without prior notice. The customer is hereby informed that the GTC valid at the time of the order are binding for orders placed through the online shop. By placing an order in the online shop, the customer acknowledges and accepts these GTC.
ORDER & PURCHASE CONTRACT
By triggering the "order with obligation to pay" button and our automatic dispatch of the order confirmation by email, your order in the ØYKAMI online shop is considered legally binding. By completing the order process, you automatically confirm that you agree to our General Terms and Conditions and the purchase contract.
PRICES
Prices are stated in Swiss Francs (CHF). Delivery costs are not included and are shown separately. ØYKAMI GmbH reserves the right to change prices at any time and without prior notice. The price at the time of contract conclusion is decisive. The respective shipping costs are shown separately to the customer and are always borne by the buyer.
PAYMENT
All payments are made in Swiss Francs (CHF). Payment for the ordered goods must be made immediately upon conclusion of the contract. The following payment methods are offered: credit cards (Mastercard and Visa), TWINT, and Paypal. All fees for payments are borne by the customer.
SHIPPING COSTS SWITZERLAND
The shipping costs within Switzerland and the Principality of Liechtenstein are CHF 8.00. We ship with the Swiss Post. Shipping costs are shown separately when ordering and are to be paid by the customer in addition to the stated product price.
AVAILABILITY AND DELIVERY
ØYKAMI GmbH endeavors to provide ongoing and up-to-date information in the online shop regarding availability and delivery. However, due to production or delivery bottlenecks, delivery delays may occur at any time and without notice. Information on availability and delivery time is therefore non-binding and subject to change at any time. The standard delivery time for shipments within Switzerland and Liechtenstein is 1-3 working days after receipt of payment. The information on delivery times is non-binding. If the standard delivery time is not met, we will inform you by email.
UNSUCCESSFUL DELIVERY
If the parcel cannot be delivered by the carrier because the recipient does not accept the parcel within the deadline (usually 10 - 14 days), the parcel will be returned at the buyer's expense and risk. ØYKAMI GmbH is not liable for the return and any costs for return transport or customs clearance/VAT must be borne by the buyer.
RETURNS & EXCHANGES In the case of a defective item, we will cover the postage costs if notification with a photo of the defective item is received within 7 days by email at info@oykami.ch. Swiss law does not provide for a return period or other right of return for online trading after the order has been sent and the confirmation email has been received. Therefore, we do not accept returns.
DEFECTS
Upon receipt of the goods, the customer must immediately check the order for defects and condition. Images and descriptions in the online shop may slightly differ from the delivered product due to different computer settings and screen graphics and do not constitute defects. A large part of our products are handmade by designers, making each product unique. Such differences in quality and production are not defects. Visible defects must be reported to us immediately, but no later than 7 working days after receipt of the goods; otherwise, the goods are deemed approved. It is best to send us an email with a picture of the defect so that we know what it is. Liability for damages is excluded. In particular, we are not liable for indirect damages or consequential damages resulting from any defects. Any claim expires in the event of improper handling or personal intervention. The ordered products may only be used for their intended purpose. The safety instructions listed in the product descriptions must be observed (see disclaimer).
DISCLAIMER / PROPER USE / ACCIDENTS
The products offered by ØYKAMI GmbH are to be used only for their intended purpose. ØYKAMI GmbH assumes no liability - the responsibility lies with the customer. Any liability lies with the buyer. The relevant legal liability provisions apply. However, ØYKAMI GmbH is not liable in particular for negligence (including slight negligence), direct or indirect damages or consequential damages, including loss of profit, as well as damages resulting from a delivery delay. Liability is also excluded if damages are due to the following reasons: improper storage or use, fire, improper repair of the products by the customer or on their behalf, as well as force majeure.
DAMAGED PACKAGE / POST LIABILITY
Packages that are externally damaged must be reported as a damage case to the nearest post office within 5 working days. The post is liable for all damages in case of loss, damage to the shipment, or incorrect delivery up to a maximum of CHF 500.00. If the customer wishes further liability or insurance, this must be arranged separately by the customer. ØYKAMI GmbH rejects any liability related to shipping.
DATA PROTECTION
Customer data is protected and not passed on to third parties. An exception is the transfer to the Swiss Post as part of order processing. ØYKAMI GmbH is entitled to use your personal data for an internal newsletter about news, special offers, and raffles. The NordlichtKinder newsletter can be unsubscribed at any time by clicking "unsubscribe from this list" or by email. ØYKAMI GmbH disclaims any liability for direct or indirect damages resulting from the loss, unauthorized disclosure, or theft of customer data.
IMAGES
All images of our products in the online shop, as well as on all other information channels maintained by ØYKAMI GmbH such as social media (Facebook, Instagram, etc.) as well as in other advertising forms, are purely illustrative and non-binding. The images in the media may therefore differ slightly from the product.
COPYRIGHT & COPYRIGHT
All content of the ØYKAMI GmbH website, Instagram, Facebook, or other media channels (texts, blog entries, graphics, photos, images, design, etc.) is the property of ØYKAMI GmbH or another rights holder and is protected by copyright. Use without our written consent is not permitted. ØYKAMI GmbH reserves all rights in case of infringement.
OTHER LEGAL PROVISIONS
If a provision of these GTC is invalid or ineffective, this does not affect the validity of the remaining provisions. In such a case, the invalid provision will be replaced by a valid one that comes closest to the economic purpose of the inapplicable provision. We reserve the right to change our GTC at any time. The version displayed during the ordering process and thus valid is decisive for each individual order. Disputes arising from concluded contracts are subject to Swiss law. The place of jurisdiction is Zurich, unless another mandatory place of jurisdiction is provided by law.
